Electronic Filing of Real Property Documents: The Fairfax Circuit Court's Electronic Filing System offers customers the option to electronically record certain land record documents with the Clerk's Office. EFS is a web-based application that allows customers to submit and record documents from remote locations without having to deliver paper documents to the courthouse. The Clerk's Office staff reviews and accepts or rejects the documents electronically and collects recording taxes and fees via ACH payments. For more information, please click here.

Fee Caps for Court Appointed Counsel: During its 2009 Session, the General Assembly included $3.6 million in the court system's 2009-10 appropriation for waivers of court-appointed counsel fee caps. As of February 16, 2010, the Supreme Court has processed payments in the amount of $3,155,260 for these approved waivers. Based on the current rate of payment, we anticipate that we will exhaust the $3.6 million appropriation by early to mid-March 2010. At that time, we will no longer be able process the approved waiver payments for the remainder of the fiscal year. General District Court Court Appointed Waiver Fees: Attorneys are reminded to submit their court appointed attorney waiver requests promptly at the conclusion of the case in the General District Court. Funding set aside for waiver fees (over and above the usual payment amount) for this fiscal year will likely be exhausted by early May. Once the money runs out, there will be no more waiver fees paid until after the start of the new fiscal year on July 1, 2010. At that time, only waiver fees incurred after July 1 will be considered for payment.

- From the VA Supreme Court: Update from the Appellate Rules Advisory Committee Report
- Gov. Timothy M. Kaine appointed Court of Appeals Judge LeRoy F. Millette Jr. to the Supreme Court of Virginia and replaced him with Chesterfield Circuit Judge Cleo E. Powell on the intermediate appellate court. Kaine also named McGuireWoods LLP partner James C. Dimitri to the State Corporation Commission. And he appointed two Circuit judges in Fairfax County, Jan Lois Brodie, deputy county attorney in Fairfax, and David S. Schell, a Juvenile and Domestic Relations district judge, in Fairfax, and Charles S. Sharp, the commonwealth's attorney in Fredericksburg, to a post in the 15th Judicial Circuit.
- Effective February 1, 2008, the Supreme Court of Virginia entered amendments to the Rules of Court. For a complete listing of the changes, please click here.
- Effective February 1, 2008, the Supreme Court briefs and other papers must be filed in one of three fonts: Courier, Arial or Verdana, and the typeface must be 14-point or larger, up from the 12 points now allowed. The page limiters remain the same, which means you can get only five-sixths as many words in briefs that you think require as many pages as allowed. Read the full story on the

- Peter J. Wiernicki has been elected Vice-President for the American Academy of Adoption Attorneys. The Academy is a national organization of over 300 attorneys who have distinguished themselves in the field of adoption law.
