2.0 MCLE Credits (Approved)

This is an advanced course about what advice lawyers can give their clients to help them make a choice about where they want to litigate in situations where they have multiple options as to where to bring a Family Law case.  This CLE describes the pros and cons of litigating in Virginia in situations where a cases may be brought in multiple states; including issues such as the difficulty of setting aside marital agreements, the ease of obtaining spousal support and the presumptive duration and amount of child support under Virginia law.  This course will also address issues to consider when litigant are deciding between bringing a case in Circuit Court or Juvenile and Domestic Relations Court, including the ease and cost of obtaining a Guardian Ad Litem, finality, Court time limits, what issues can be resolved, presumptive custody arrangements in each Court, as well as evidentiary considerations. This course will also address which Virginia venue makes the most sense for clients who have options.   (Beginning lawyers should attend “Where Can I Bring My Case?: Jurisdiction Options in Family Law Cases” before attending this CLE as this CLE assumes knowledge of the various jurisdiction options in Family law cases.
