Message to the Bar concerning Substitute Judge Positions from Chief Judge White


The response to the notice of selection of substitute judges has resulted in the court receiving almost forty applications for consideration by the court.  We anticipate filling as many as three positions at the February judges meeting.

The process that will be followed is the same process that has been followed for many years.  Although the Code gives the Chief Judge of the Circuit Court the authority to make the appointments, the Fairfax Circuit Court makes the selections as a group. The names and resumes of all of the applicants are distributed to all of the Circuit Court Judges in advance of the selection meeting.  They are also provided to the Chief Judges of the General District Court and the Juvenile and Domestic Relations District Court for review and comment by the judges of those courts.

In making the selections the Circuit Court considers among other things:  the observations and firsthand experiences of the Circuit Court bench, the input of sitting judges from all three of the courts, the results of any interviews and evaluations and bar votes that an applicant may have had in connection with pursuing a full time position as a judge.  Letters or calls of recommendation are discouraged as are personal solicitations of the judges by applicants.  The selection process itself and any individual judge’s comments or votes during the process are deemed confidential by the judges.

We are appreciative of the interest in the openings and will continue do our best to select substitute judges who will serve the community with distinction.
