Fairfax GDC - Civil Procedures Update

  1. Effective July 10, 2020, Fairfax GDC will begin to hear residential unlawful detainer actions.  Effective June 29th, Fairfax GDC will begin to issue Writs of Eviction.
  2. Please see the CARES ACT update for temporary procedures to be employed and required affidavits for new and existing filings.  These procedures will be updated and affidavits available on our court’s website sometime Monday morning, at which time I will forward you the website links. In the meantime, I have attached them to this email.
  3. Finally, the Court relies on counsel to be prepared and timely for their scheduled dockets. During pandemic segmented dockets, counsel must be in the appointed court hearing and not attempt to be in two places at once. Gone are the days when an attorney could float between courtrooms to tend to multiple matters and clients at one time. If attorneys are late or miss their dockets, they run the risk of the matters being dismissed. In addition, the Court has noticed that some attorneys have not completed the appropriate file review. Please check your files prior to the scheduled court date, check on service status (see #4 below), and sign in advance for any garnished funds that are in the file – the funds will be distributed on your court date, so be sure to have a representative available to accept the funds.    
  4. You are able to check your court files prior to your court date or between 8:00AM – 9:00AM on the morning of your court date. A reminder that you can also check service status on the Sheriff’s Civil Enforcement webpage:  https://www.fairfaxcounty.gov/sheriff/civil-enforcement. Click the red button labeled “Search service status of your civil documents à” to go to the ACES Public Website and begin your search.
